Terms and Conditions of the SonexMeble Antyki Online Store

§1 General provisions
1. These Regulations define the rules of using the online store available at sonex-meble.pl and the rules of sales conducted by Sonex Meble Antyki in the stationary and online store.
2. The owner of the store is Sonex Jakub Mirowski with its registered office at Księdza Konstantego Budkiewicza 51, 05-091, Ząbki, entered into the Central Registration and Information on Business (CEIDG), Tax Identification Number (NIP) 1182268239 and National Business Registry Number (REGON) 526205982, hereinafter referred to as the seller.
3. Contact with the Seller is possible via e-mail address sonexmeble@gmail.com, telephone number +48 786 402 466 or correspondence address Księdza Konstantego Budkiewicza 51, 05-091, Ząbki.
4. The Regulations are continuously available on the website sonex-meble.pl in a manner enabling their acquisition, reproduction and recording by the Customer.
5. The Regulations are addressed to both consumers and entrepreneurs making purchases in the Store, subject to the provisions addressed solely to Consumers.
6. The goods offered in the Store are antique furniture and other antique items, which are used goods and may have natural traces of use resulting from their age and history.
§2 Definitions
For the purposes of these Regulations, the following terms shall have the following meanings:
1. Seller – an entrepreneur running a business under the name Sonex Jakub Mirowski, indicated in §1 of the Regulations.
2. Online Store – a store run by the Seller at sonex-meble.pl, enabling the placement of Orders for Products via the Internet.
3. Stationary Store – a point of sale run by the Seller at Księdza Konstantego Budkiewicza 51, 05-091, Ząbki, where the Customer has the opportunity to view and purchase Products in person.
4. Customer – any natural person, legal person or organizational unit without legal personality who makes a purchase in the Online Store or Stationary Store or uses the services offered by the Seller.
5. Consumer – a Customer who is a natural person making a purchase in the Store for purposes not directly related to the conducted business or professional activity, within the meaning of Article 22¹ of the Civil Code.
6. Entrepreneur with Consumer Rights – a natural person concluding a contract directly related to his/her business activity, if the content of this contract indicates that it is not of a professional nature for this person, resulting in particular from the subject of the activity performed.
7. Product – an antique piece of furniture, a piece of old furniture or other item offered for sale by the Seller, with features and traces of use related to its age and history, being a unique product, often occurring in a single copy.
8. Bulky Product – A product of large dimensions or weight, the delivery of which requires a special method of packaging, transport or individual arrangement of delivery terms with the Customer.
9. Order – a declaration of will of the Customer submitted via the Order Form available in the Online Store or in another manner accepted by the Seller, directly aiming at concluding a Product Sales Agreement.
10. Sales Agreement – a Product sales agreement concluded between the Seller and the Customer under the terms and conditions specified in the Regulations, using means of distance communication or in a stationary Store.
11. Regulations – this document specifying the rules for using the Online Store and the Stationary Store, as well as the rules for concluding and performing Sales Agreements.
12. Working days – days from Monday to Friday, excluding public holidays.
13. Contact form – a form available in the Online Store that allows you to fill out the fields and contact the seller in order to place an order for a Product or to obtain other information about the products and the operation of the online and stationary store.
§3 Rules for using the Online Store
1. The Customer is obliged to use the Online Store in a manner consistent with applicable law, the provisions of these Regulations and good practices, as well as in a manner that does not infringe the rights of third parties and the rights of the Seller.
2. To use the Online Store, it is necessary to meet the following minimum technical requirements:
• a device with Internet access,
• an up-to-date web browser that allows you to view web pages,
• active e-mail address.
3. The Customer is obliged to provide true and current data necessary for the proper execution of the Order and to refrain from any actions that may disrupt the functioning of the Online Store.
4. If the Customer provides false or outdated data, the Seller shall not be liable for the inability to complete the Order.
5. The Customer is prohibited from providing content that is illegal, offensive, misleading or infringes the rights of third parties.
6. Product photos and descriptions posted in the Online Store are for illustrative purposes only. Due to the unique nature of the Products (antique furniture and antiques), there may be differences in the colors, shades, or details visible in the photographs. This does not constitute a non-compliance of the Product with the Sales Agreement. Each Product has an individual description, and the Customer may obtain additional information or photos of a given Product by contacting the Seller before placing an Order.
§4 Placing Orders and Concluding a Sales Agreement
1. Orders in the Online Store may be placed by the Customer in the following manner:
a) in the case of regular Products – by adding the Product to the cart and making an online payment using available payment methods or by contacting the Seller directly (by phone, email or via the contact form),
b) in the case of bulky Products – only by direct contact with the Seller (by phone, e-mail or via the contact form), in accordance with the procedure described in paragraphs 2–7.
2. The process of placing an Order for Bulky Products follows the following steps:
1. Contact – The Customer contacts the Seller to agree on the details of the selected Product and individual shipping costs.
2. Placing an Order – after determining the terms and conditions, the Customer sends an email confirming their willingness to purchase.
3. Reservation – The Seller reserves the selected Product for the Customer for a period of 48 hours and provides payment details.
4. Payment – The Customer makes the payment by bank transfer to the Seller’s account indicated in the Regulations or in e-mail correspondence, specifying the name of the Product and the name and surname in the transfer title.
5. Shipping – After payment is received, the Seller ships the Product to the Customer. Standard delivery time is 3 to 5 business days, unless otherwise agreed.
6. Collection of the Product – the shipment is delivered directly to the address indicated by the Customer.
3. Placing an Order means that the Customer submits to the Seller an offer to conclude a Sales Agreement for selected Products.
4. In the event of placing an Order via the shopping cart and making an online payment, the Sales Agreement is concluded upon receipt by the Customer from the Seller of confirmation of acceptance of the Order for execution in the form of an e-mail.
5. In the case of Orders placed via direct contact, the Sales Agreement is concluded upon confirmation by the Seller of acceptance of the Order and agreement on all terms, including price, delivery costs and delivery date.
6. The Seller reserves the right to limit the availability of a given item to a single item due to the unique nature of the Products. If an Order is placed for a Product that has already been sold, the Seller will inform the Customer and the Order will not be fulfilled.
7. The Seller may refuse to process the Order in the event of:
a) the Customer provides incorrect or incomplete data,
b) it is impossible to contact the Customer to confirm the details of the Order,
c) other justified reasons preventing the execution of the Order, about which the Seller will inform the Customer.
§5 Prices and payments
1. The prices of all Products presented in the Online Store are expressed in Polish zloty (PLN) and are gross prices, i.e. they include value added tax (VAT) and all other taxes required by law.
2. Product prices do not include delivery costs or other additional services, which are determined separately and presented to the Customer before concluding the Sales Agreement.
3. The Customer may pay for the Order in the following ways:
a) in the case of standard Products:
• online payment via payment systems available in the Online Store,
• payment by bank transfer to the Seller's account,
• other payment methods available in the Store when placing the Order;
b) in the case of bulky Products – payment only by bank transfer to the Seller's account indicated in section 6.
4. Payment by bank transfer should be made within the time agreed with the Seller, but no later than within 3 business days from the date of receipt of information about the payment details from the Seller.
5. The Order will be fulfilled after the full amount has been credited to the Seller's bank account, unless the parties agree otherwise.

7. The Seller reserves the right to refuse to process an Order if payment is not received within the specified timeframe. In such a case, the Order will be canceled and the Customer will be notified accordingly.
§6 Delivery and collection of Products
1. Delivery of Products takes place within the territory of the Republic of Poland, unless the Seller and the Customer agree otherwise.
2. For standard Products, the following delivery methods are available:
a) courier delivery,
b) personal collection at the Seller's stationary store at Księdza Konstantego Budkiewicza 51, 05-091, Ząbki.
3. The delivery time for standard Products is from 3 to 5 business days from the date of payment being credited to the Seller's bank account, unless a different time limit is indicated in the Product description or in individual arrangements with the Customer.
4. In the case of bulky Products, delivery is only via transport individually agreed upon with the Seller. The delivery cost and delivery date are agreed upon with the Customer each time before concluding the Sales Agreement.
5. Delivery costs are presented to the Customer before concluding the Sales Agreement.
6. If personal collection is selected, the Customer is obliged to collect the Product within the time agreed with the Seller.
7. The Customer is responsible for inspecting the condition of the shipment upon receipt. If any damage occurs during transport, it is recommended to complete a damage report in the presence of the courier and immediately notify the Seller. The Customer acknowledges that Products that are antique or vintage furniture may show signs of wear and age (including abrasions, cracks, discoloration), which do not constitute damage caused during transport or non-compliance with the Sales Agreement.
8. The risk of accidental loss or damage to the Product passes to the Customer upon its delivery to the Customer.
§7 Right of withdrawal
1. A Customer who is a Consumer has the right to withdraw from a Distance Selling Agreement within 14 days without giving any reason by submitting an appropriate declaration to the Seller.
2. The 14-day period is counted from the day on which the Customer or a third party indicated by him, other than the carrier, came into possession of the Product.
3. To meet the deadline, it is sufficient to send a declaration of withdrawal from the Sales Agreement before its expiry. The declaration may be sent in writing to the Seller's address: Księdza Konstantego Budkiewicza 51, 05-091, Ząbki, or electronically to the email address indicated in §1 of the Regulations.
4. In the event of withdrawal from the contract, the Sales Agreement is deemed null and void. The Seller will refund all payments made by the Customer, including the costs of delivering the Product (excluding additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller), immediately, but no later than within 14 days of receiving the Customer's declaration of withdrawal from the contract.
5. Refunds will be made using the same payment method used by the Customer, unless the Customer expressly agrees to a different refund method that does not involve any costs for the Customer.
6. The Seller may withhold reimbursement until the Product is received back or the Customer provides proof of sending it back, whichever occurs first.
7. The Customer is obligated to return the Product to the Seller immediately, but no later than 14 days from the date on which they withdrew from the contract. To meet the deadline, it is sufficient to return the Product before its expiry. The returned Product should be sent to the Seller's address: Księdza Konstantego Budkiewicza 51, 05-091, Ząbki.
8. The Customer bears the direct costs of returning the Product, including packaging, security, and shipping costs. For bulky Products, these costs may be significant and the Customer is obligated to cover them.
9. The Customer is liable for any reduction in the value of the Product resulting from its use in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Product.
10. The Customer acknowledges that Products that are antique or vintage furniture may show signs of wear and age, as described in the offer and documented with photographs. Such features cannot be considered grounds for withdrawal from the Sales Agreement or for filing a complaint regarding non-conformity of the Product with the Agreement.
§8 Complaints and Product Compliance with the Contract
1. The Seller is liable to the Customer who is a Consumer and an Entrepreneur with Consumer rights for the compliance of the Product with the Sales Agreement, under the terms specified in the Consumer Rights Act.
2. The Seller's liability covers any lack of conformity of the Product with the contract existing at the time of delivery and discovered within two years of that date. In the case of used Products, the liability period may be shortened to one year, of which the Customer will be informed in the description of the Product before concluding the Sales Agreement.
3. The products offered in the Store are used items – antique furniture and vintage items – and may have natural signs of use and age (such as abrasions, cracks, discoloration, coating defects, minor material deformations). These features, if disclosed in the description, photographic documentation, or provided to the Customer before concluding the contract, do not constitute a lack of conformity of the Product with the contract.
4. A complaint may be filed if it is found that the delivered Product is inconsistent with the contract in a manner other than that specified in paragraph 3.
5. Complaints can be submitted:
a) in writing to the Seller's address,
b) electronically to the e-mail address indicated in §1 of the Regulations.
6. The complaint should include: the Customer's name and surname, contact details, Order number, description of the non-conformity and – if possible – photographic documentation.
7. The Seller will respond to the complaint within 14 days of its receipt. Failure to respond within this timeframe will constitute acceptance of the complaint.
8. If the complaint is accepted, the Seller will make every effort to bring the Product into compliance with the contract by repairing it, if this is possible and does not entail excessive costs due to the unique nature of the Product.
9. If the repair of the Product is impossible, excessively expensive, will not be completed within a reasonable time or without excessive inconvenience to the Customer, the Customer may demand a price reduction or withdraw from the contract, provided that the right to withdraw from the contract is not available if the lack of conformity of the Product with the contract is immaterial.
10. In the event of a price reduction, a partial refund will be made immediately, no later than 14 days from the date the complaint is accepted, to the bank account indicated by the Customer or in the same manner as the original payment.
11. In the event of withdrawal from the contract, the Seller will refund the Customer the full amount paid, including the cost of shipping the Product, immediately, no later than 14 days from the date of receipt of the returned Product. The refund will be made using the same payment method used by the Customer, unless the Customer expressly consents to a different refund method.
12. Returning or handing over the Product as part of a complaint is at the Seller's expense. The Customer is obligated to appropriately secure the Product for transport.
13. The provisions of this section apply accordingly to Entrepreneurs with Consumer rights. In the case of Customers who are entrepreneurs other than Entrepreneurs with Consumer rights, the Seller's liability is governed by the provisions of the Civil Code, unless the parties agree otherwise.
§9 Seller's liability and limitations
1. The Seller exercises due diligence to ensure that the Online Store operates correctly and continuously, but does not guarantee that the use of the Store will be free from any interruptions and errors.
2. The Seller reserves the right to temporarily suspend the operation of the Online Store for technical, maintenance or system update reasons, and will make every effort to ensure that these interruptions are as inconvenient as possible for Customers.
3. The Seller shall not be liable for the inability to use the Online Store resulting from reasons beyond its control, in particular for reasons attributable to telecommunications service providers, device failures or force majeure.
4. The Seller shall not be liable for errors in the presentation of the Products if they result from the settings of the Customer's end device or the software with which the Customer uses the Online Store (e.g. monitor settings affecting the display of colors).
5. The limitations of the Seller's liability set out in this paragraph are not intended to exclude or limit liability towards the Customer who is a Consumer or an Entrepreneur with Consumer rights to the extent that this would be contrary to applicable law.
§10 Personal data
1. The administrator of Customers' personal data is the Seller, i.e. Sonex Jakub Mirowski.
2. Customers' personal data are processed in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
3. Detailed rules regarding the processing of personal data, including purposes, legal basis, storage periods and Customer rights, are specified in the Privacy Policy, available on the Store's website.
§11 Final provisions
1. The Regulations are continuously available on the website sonex-meble.pl in a manner enabling their acquisition, reproduction and recording by the Customer.
2. The Seller reserves the right to change the Regulations for important legal, organizational or technical reasons, in particular in the event of changes in legal regulations, changes in payment methods, delivery methods or operation of the Online Store.
3. Amendments to the Regulations do not affect Orders placed before their effective date – such Orders shall be subject to the provisions of the Regulations in force at the time of their submission.
4. In matters not regulated in the Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
5. Disputes arising from the Sales Agreement between the Seller and the Customer will be resolved by common courts having jurisdiction in accordance with the provisions of law.
6. A Customer who is a Consumer also has the option of using out-of-court complaint and redress procedures, including assistance from municipal or district consumer ombudsmen, as well as the ODR platform available at: https://ec.europa.eu/consumers/odr/.
