§7 Right of Withdrawal from the Contract

1. A Customer who is a Consumer has the right to withdraw from a  distance sales contract within 14 days without giving any reason, by submitting an appropriate declaration to the Seller.

2. The 14-day period shall be calculated from the day on which the Customer or a third party indicated by the Customer, other than the carrier, takes possession of the Product.

3. To meet the deadline, it is sufficient to send the declaration of withdrawal from the sales contract before its expiry. The declaration may be sent in writing to the Seller’s address: Księdza Konstantego Budkiewicza 51, 05-091, Ząbki, or electronically to the e-mail address indicated in §1 of the Regulations.

4. In the event of withdrawal from the contract, the sales contract shall be deemed not concluded. The Seller shall refund all payments made by the Customer, including the costs of delivery of the Product (except for additional costs resulting from the Customer’s choice of a delivery method other than the cheapest standard delivery method offered by the Seller), without undue delay and no later than 14 days from the date of receipt of the Customer’s declaration of withdrawal.

5. The refund shall be made using the same means of payment as used by the Customer, unless the Customer expressly agrees to a different method of refund that does not incur any costs for the Customer.

6. The Seller may withhold the refund until the Product is received back or until the Customer provides proof of having sent the Product back, whichever occurs first.

7. The Customer is obliged to return the Product to the Seller without undue delay, but no later than 14 days from the day on which the Customer withdrew from the contract. To meet the deadline, it is sufficient to send the Product back before its expiry. The returned Product should be sent to the Seller’s address: Księdza Konstantego Budkiewicza 51, 05-091, Ząbki.

8. The Customer shall bear the direct costs of returning the Product, including the costs of packaging, securing, and transport. In the case of oversized Products, these costs may be significant and shall be borne by the Customer.

9. The Customer is liable for any reduction in the value of the Product resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the Product.

10. The Customer acknowledges that Products which are antique furniture or antiques may have natural signs of use and age, which are described in the offer and documented with photographs. Such characteristics shall not constitute grounds for withdrawal from the sales contract or for a complaint based on non-conformity of the Product with the contract.
